 General

• MyPrivateTourGuide provides an online platform with technology for Travelers & Tour Guides to meet online. MyPrivateTourGuide is solely acting as a commercial agent for the Tour guides.
• MyPrivateTourGuide is not an operator of Tours, nor is it a provider of Tours, nor a representative or proxy of an Operator nor an insurer.
• MyPrivateTourGuide’s responsibilities are limited to exclusively facilitating the availability of the Services and serving as the commercial agent of each Tour Guide.
• MyPrivateTourGuide has no control over the conduct of Travelers, Tour Guides and other users of the Services.
• MyPrivateTourGuide cannot and doesn’t control the content contained in any listing or condition, legality or suitability of any tours.
• MyPrivateTourGuide is neither responsible nor liable for to any listing and tours. Bookings with the Tour Guides are made at the Traveler’s own risk.

Applicability

These terms and conditions (“Terms”), as amended from time to time, apply to all MyPrivateTourGuide services.

• By using the MyPrivateTourGuide.com Site, you agree to comply with and be legally bound by these terms Irrespective of a registration or certain use or way of access.
• These Terms govern your access to and use of the Site and Services and all Content (as defined below) vis-à-vis com and, where applicable, the Tour Guides.
• Please carefully read these Terms and also the Privacy Policy and the Legal Notice, each of which is incorporated by reference into these Terms.
• If you do not fully agree to these Terms, you have no right to continue using the Site.
• If you are using this Website and/or making tour bookings for another person you agree to inform that person(s) about the Terms & Conditions that apply to the tour bookings you have made on their behalf, including all rules and restrictions applicable thereto and these Terms of Use.
• You agree to be financially responsible for all of your use of the Website (as well as for use of your account by others).
• You are responsible for any bookings made by persons under your direction or control.
• You also warrant that all information supplied by you or on your behalf, or by members of your household in using the Website is true, current, complete, and accurate. Furthermore, you also confirm that the Traveler is not an unaccompanied minor. Without limitation, any exploratory, speculative, false, or fraudulent reservation or any reservation in anticipation of demand is prohibited.

Eligibility

The Services are intended solely for persons who are aged 18 years or older. By accessing or using the Services you guarantee that you are 18 years or older.

Disclaimer of Warranties

You expressly agree that the use of this site is at your sole risk. MyPrivateTourGuide doesn’t warrant that the site will be uninterrupted or error-free; nor do we make any warranty as to the results that may be obtained from the use of the site, or as to the accuracy, reliability or content of any information, service or merchandise provided through the site. THE SITE IS PROVIDED ON AN “AS IS” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTIBILITY OR FITNESS FOR A PARTICULAR PURPOSE.

Reporting Claims of Copyright Infringement

If you believe that materials hosted by us infringes your copyright, please submit to us a notice including all of the information requested below. If you fail to provide all of the requested information, we will not process your notice. You may wish to seek legal counsel prior to submitting a copyright infringement notice. You could be held liable for alleging false claims of copyright infringement.

• A physical signature of the person authorized to act on behalf of the owner of the copyrighted work;
• A description of the copyrighted work that you claim has been infringed upon;
• A description of where the material that you claim is infringing is located on the Site;
• Your address, telephone number, and e-mail address;
• A statement by you that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
• A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.

We reserve the right in appropriate circumstances to remove content on the Website alleged to be infringing without prior notice, and/or to terminate the accounts of users who infringe any intellectual property rights of others.

Bookings and Payments

You agree to pay for the “Total Cost” (including the price of the tour and, where applicable, taxes, levies and duties) for any booking requested, in accordance with the pricing terms set forth in the applicable booking page, if such requested bookings are confirmed by the applicable Tour Guide. The availability and price of a Tour can change any time until you have received a booking confirmation.
MyPrivateTourguide in its own discretion collects (through third party payment processors) the Total Cost (as one payment or deposit plus balance payments) for and on behalf of the Tour Guides as its commercial agent. You hereby authorize the collection of such amounts by charging the credit/debit card provided as part of requesting the booking, or by one of the other payment methods as described on the Site.

Bank and Credit Card Fees
Please note that some banks and credit card companies impose fees for international transactions. If you are making a booking from outside of the United States on a US credit card, your bank may convert the payment amount to your local currency and charge you a conversion fee. This means the amount listed on your credit or bank card statement may be in your local currency and therefore a different figure than the figure shown on the billing summary page for a reservation booked on the Website. In addition, a foreign transaction fee may be assessed if the bank that issued your credit card is located outside of the United States. Booking international travel may be considered to be an international transaction by the bank or card company, since MyPrivateTourGuide may pass on your payment to an international travel supplier. The currency exchange rate and foreign transaction fee is determined solely by your bank on the day that they process the transaction. If you have any questions about these fees or the exchange rate applied to your booking, please contact your bank.

International Travel
By offering tours in particular international destinations, MyPrivateTourGuide does not represent or warrant that travel to such areas is advisable or without risk. MyPrivateTourGuide will not be liable for damages or losses that result from travel to such destinations.
You and any children traveling with you must be in possession of a machine-readable passport valid for 6 months after their trip return date along with applicable visas. It is your sole responsibility to secure and/or pay for any and all visas, reciprocity fees, affidavits, immunizations, accommodation, insurance etc. that are required to be permitted entry into each destination. In some countries you may be subject to entry (reciprocity) fees and/or departure taxes/exit fees which will be collected at the airports upon entry/departure by local government authorities. Please note that entry to any country may be refused even if the required information and travel documents are complete.
For up-to-date detailed information on travel documents and visas, entry/exit taxes and further information on entry and exit requirements please check with your local consular services.

Health: Recommended inoculations for travel may change and you should consult your doctor for current recommendations before you depart. It is your responsibility to ensure that you meet all health entry requirements, obtain the recommended inoculations, take all recommended medication, and follow all medical advice in relation to your trip.

Cancellations & Refunds

Traveler Cancellations and Refunds

• Any cancellation by You (The Traveler) must be made by  email and acknowledged by MyPrivateTourGuide. The date on which the request to cancel is received by MyPrivateTourGuide will determine the refund according to the Partners (Tour guides) cancellation policy, that is why we highly recommend to check the cancellation policy with the tour guide. As each guide will have different cancellation policy or fees.
• Force Majeure: includes impersonal events such as war, civil insurrection, strikes, volcanoes, extreme weather, earthquake or natural disaster that makes it dangerous or impossible to safely undertake the tour. The determination of what constitutes ‘Force Majeure’ is at the discretion of me. However, a travel warning issued by the your government AFTER you book your tour invokes ‘force majeure’ you are covered under this ‘Force Majeure’ provision. And in this case a full refund is issued minus the service fees or processing fees.
• The money may take up 30 business days to be back in your PayPal balance, credit/debit card or bank account.
• Traveler who submits an application for cancellation shall bear the cost arising thereof, such as service fees or processing fee.
• MyPrivateTourGuide reserves the rights to adjust and modify all the fees policy.

You are strongly encouraged to obtain cancellation insurance. In certain circumstances, this will cover the cost of cancellation.

Tour Guide Cancellations and Refunds
If a Tour Guide cancels a confirmed booking made via the Services, a refund of the paid amount for such booking will be made to the applicable Traveler within a commercially reasonable time of the cancellation by the Tour Guide and the Traveler may receive an email or other communication from MyPrivateTourGuide containing non-binding suggestions for alternative Listings and other related information. If a Tour Guide cancelled a confirmed booking and you, as a Traveler, have not received an email or other communication from MyPrivateTourGuide, please contact MyPrivateTourGuide at  info@myprivatetourguide.com .

Modifications

MyPrivateTourGuide reserves the right to modify the Terms at any time without prior notice. Any changes will become effective immediately upon use of the Site post change constituting an acceptance of the modified Terms. If the modified Terms are not acceptable to you, your only recourse is to cease using the Site.
